These Terms of Use govern access to and use of the Rental Pay Portal (“Portal”) by tenants and authorized users of participating rental properties.
By accessing or using this Portal, you agree to these Terms.
1. Purpose of the Portal
The Portal provides tenants with the ability to:
- View rent amounts and due dates
- Submit rent payments
- View payment history
- Submit maintenance requests
- Receive digital notices and updates
The Portal is for authorized tenant use only.
2. Lease Agreement Controls
Use of this Portal does not replace or modify the signed lease agreement.
In the event of any conflict between information shown in the Portal and the lease agreement:
The signed lease agreement shall control.
3. Rent Payments
Rent amounts, payment windows, and applicable fees are determined by each tenant’s lease agreement.
Landlords may configure:
- Base rent amount
- Payment window
- Late fee percentage or flat fee
- Administrative or notice fees
Tenants are responsible for paying rent in accordance with their lease, regardless of Portal access.
4. Late Fees & Additional Charges
Late fees may be automatically or manually applied according to the lease agreement.
Additional charges may include:
- Late fees
- Returned payment fees
- Administrative fees
- Legal or notice fees (where applicable by law)
All fees must comply with applicable state and local laws.
5. Payment Processing
Payments are processed through a third-party payment processor (such as Stripe).
The Portal:
- Does not store full credit card information
- Uses encrypted payment processing
- Is not responsible for bank delays, card declines, or processor outages
Tenants are responsible for ensuring successful payment submission.
6. Maintenance Requests
The Portal allows tenants to submit maintenance requests electronically.
Submitting a request:
- Does not guarantee immediate repair
- Does not authorize tenant-performed repairs
- Does not alter lease obligations
Emergency issues must be reported directly using the emergency contact provided by the landlord.
7. Account Security
Tenants are responsible for:
- Maintaining the confidentiality of login credentials
- Ensuring account activity is authorized
- Not sharing access with unauthorized persons
The landlord reserves the right to suspend accounts in cases of misuse or security risk.
8. Availability of Service
The Portal is provided “as available.”
The landlord is not liable for:
- Temporary downtime
- Technical interruptions
- Maintenance-related service delays
- Third-party processing failures
Tenants remain responsible for timely rent payment even if the Portal is temporarily unavailable.
9. Privacy & Data Use
Personal information collected through the Portal is used solely for:
- Rent collection
- Maintenance coordination
- Lease-related communication
- Legal compliance
Information is not sold or shared for marketing purposes.
10. Modifications
The landlord reserves the right to update these Terms at any time.
Continued use of the Portal constitutes acceptance of any revisions.
11. Governing Law
These Terms shall be governed by the laws of the state in which the rental property is located.
